Hereinafter "the Vendor"

Article 1 - Application of Terms and Conditions of Sale - Enforceability

The present General Terms and Conditions of Sale constitute the basis for commercial negotiations and shall be systematically forwarded or presented to each purchaser to enable that party to place their order.

They shall take precedence over any Terms and Conditions of Purchase except in the case of formal written acceptance thereof by the Vendor. Any additional, different or conflicting terms or conditions invoked by the Purchaser shall therefore not be enforceable against the Vendor unless expressly agreed to, regardless of the time when it is apprised thereof.

Should the Vendor not avail itself of any one of these General Terms and Conditions of Sale at a given time, this may not be interpreted as constituting renunciation of availing itself of any of the aforementioned conditions whatsoever at a later date.

Article 2 - Operations included in the context of a Tourist Package

It is hereby specified that a Tourist Package comprises the services:

  • resulting from the prior combination of at least two operations involving, respectively, transportation, lodging, or other tourist services not accessory to transportation or lodging and representing a significant share of the package fee;
  • exceeding twenty-four hours or including a night's lodging;
  • sold or offered for sale at an all-inclusive price.

Article 3 - Mandatory declarations

In conformity with the provisions of Article R.211-12 of the French Tourism Code, Articles R.211-3 to R.211-11 of said Code are reproduced in their entirety hereinafter:

Article 4 - Booking - Absence of right of withdrawal

Under the present General Terms and Conditions, a Booking is a reservation submitted by the Purchaser and for which the Vendor has confirmed availability.

Full acceptance of the present General Terms and Conditions of Sale shall be effective:

  • with the handwritten signature of the purchaser
  • with the checking of a checkbox and the communication of the Purchaser's personal information in the case of online sale.

It is to be noted that according to Article L. 121-20-4 - 2° of the Consumer Code, the right of withdrawal to which consumers are entitled in the context of a distance sale does not apply to accommodation, transport, catering or leisure services provided on a specific date or for a specific period.

Article 5 - Price

Prices indicated are calculated as excluding taxes and in euros.

In conformity with the provisions of Article L.211-10 of the French Tourism Code, the price of the Tourist Package can be modified before the departure date to take into account variations affecting:

  • transportation costs, in particular related to fuel costs,
  • dues, taxes or fees chargeable for certain services (such as landing taxes or embarkation or disembarkation fees at ports and airports) whose amounts vary with the destination and are subject to change by the local authorities,
  • the exchange rates applied when a part of the services provided is billed to the Vendor in a foreign currency.

Article 6 - Cancellation of a booking

Any cancellation, total or partial, by the Purchaser shall incur payment of fees of up to 100% of the price of the stay, and which are detailed in the Specific Terms and Conditions.

When the purchaser reserves an excursion, cruise, or stay whose execution is contingent upon a minimum number of participants, the reservation is accepted under the suspensive condition that said minimum number of participants be reached.

In certain cases, the service will be able to take place despite the insufficient number of participants in exchange for a price supplement which shall be requested of the Purchaser. Should said price increase be significant, the Purchaser shall have the option either to accept the increase in price or to cancel the contract and obtain reimbursement of the amounts remitted without penalty.

Article 7 - Administrative and health formalities

The Vendor calls the attention of the Purchaser to the fact that provision of the services booked is generally contingent on compliance with prior administrative and health formalities.

Specifically, the Vendor recommends that the Purchaser consult all the information on the destination or transit countries on the Web sites www.diplomatie.gouv.fr and www.action-visas.com.

All fees relating to these formalities are the responsibility of the Purchaser. No reimbursement shall be made by the Vendor should the Purchaser be penalized or unable to depart on a trip due to failure to comply with said formalities.

Article 8 - Liability

Regarding Tourist Packages, the Vendor's liability is defined in Article L.211-16 of the French Tourism Code. Accordingly, the Vendor may in no case be held liable in case of non-execution attributable to the Purchaser, to actions by a third party not involved in the provision of the services, or to a case of Force Majeure.
